Implementation of Victim of Crimes Law

The Kenya Kwanza Government promised to implement the Victims of Crime Law.

 

  • Following a petition to the National Assembly regarding a delay in the implementation of the Victim Protection Act, 2014, the National Assembly Standing Committee on Justice, Legal Affairs and Human Rights (JLAHRC) in 2023 recommended that the Office of the Attorney General sets up a working group on the implementation of the VPA, including the review of the draft Victims Rights Charter, the draft Victim Protection (General) Regulations and the Victim Protection (Trust Fund) Regulations and, within six months, to submit the same for approval by the National Treasury and Parliament as appropriate. As at October 2025, neither of the Regulations have been published.
  • Additionally, JLAHRC committed to initiate a review of the VPA with a view to enacting amendments to ensure the full implementation of Article 50 (9) of the Constitution of Kenya. However, as at October 2025, no amendment bill has been tabled in Parliament to this end.
  • Implementation remains constrained by limited financial and institutional capacity.
